By creating an account, accessing, or using Munchable, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy, which is incorporated herein by reference.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through an in-app notification. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
These Terms constitute a legally binding agreement between you and Munchable. You represent that you have the legal capacity and authority to enter into this agreement.
You must be at least 13 years of age to create an account and use Munchable. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service. We reserve the right to terminate accounts if we discover a user is under 13 years of age.
When registering for an account, you agree to provide accurate, current, and complete information. You must keep your account information up to date at all times. Providing false, misleading, or fraudulent information may result in immediate suspension or termination of your account.
You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree to:
Munchable will not be liable for any loss or damage arising from your failure to protect your account credentials.
You retain ownership of all content you create, upload, or share on Munchable ("User Content"), including food photos, reviews, recipes, comments, and other materials. Munchable does not claim ownership of your User Content.
By posting User Content on Munchable, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, display, reproduce, distribute, modify, and adapt your User Content solely for the purposes of operating, promoting, and improving the Service. This license exists only for as long as your content remains on the platform and terminates when you delete your content or your account, except where your content has been shared by other users or is reasonably necessary for the operation of the Service.

We reserve the right to remove any User Content that violates these Terms, at our sole discretion and without prior notice.
When using Munchable, you agree not to engage in any of the following prohibited activities:
Violations of this Acceptable Use policy may result in content removal, account suspension, or permanent termination at our sole discretion.
Munchable offers an optional premium subscription service called "Munchable+" that provides access to enhanced features and functionality. Details of available plans and pricing are displayed within the app and on our website.
All payments for Munchable+ are processed securely through Stripe. By subscribing, you authorize Stripe to charge your chosen payment method for the applicable subscription fee. You agree to provide accurate and complete billing information and to keep it up to date.
Munchable+ subscriptions automatically renew at the end of each billing cycle (monthly or annually, depending on your chosen plan) unless you cancel before the renewal date. The renewal charge will be the same as your current subscription rate unless we have notified you of a price change in advance.
You may cancel your Munchable+ subscription at any time through your account settings. Upon cancellation:
Subscription fees are generally non-refundable. However, if you believe you have been charged in error or experience a billing issue, please contact us at hello@munchable.io and we will review your request on a case-by-case basis. Refund eligibility is determined at our sole discretion.
Munchable offers a paid Post Boost feature that allows users to promote their food posts to a wider audience on the platform. Post Boosts increase the visibility of your content by placing it in front of more users.
While Post Boosts are designed to increase the reach and visibility of your content, Munchable does not guarantee any specific results, including but not limited to a particular number of views, likes, comments, follows, or other engagement metrics. The actual performance of a boosted post depends on many factors, including content quality, relevance, timing, and audience behavior.
All purchases of Post Boosts are final and non-refundable. Once a Post Boost has been purchased and applied, the charge cannot be reversed. By purchasing a Post Boost, you acknowledge and accept this non-refundable policy. If you experience a technical issue that prevents your boost from being delivered, please contact us at hello@munchable.io and we will investigate and resolve the issue.
The Service, including its original content (excluding User Content), features, functionality, design, source code, graphics, logos, and overall look and feel, is and shall remain the exclusive property of Munchable and its licensors. The Service is protected by copyright, trademark, trade dress, and other intellectual property laws of the United States and international jurisdictions.
The Munchable name, logo, "Munchable+" branding, and all related names, logos, product and service names, designs, and slogans are trademarks of Munchable. You may not use these marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Service are the trademarks of their respective owners.
If you provide us with feedback, suggestions, or ideas regarding the Service ("Feedback"), you grant Munchable a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into the Service without any obligation or compensation to you.
Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into and forms part of these Terms of Service. By using Munchable, you consent to the data practices described in our Privacy Policy.

You may terminate your account at any time by deleting it through your account settings or by contacting us at hello@munchable.io. Upon termination, your right to use the Service will immediately cease, and your data will be handled in accordance with our Privacy Policy.

Upon termination of your account, your license to use the Service will immediately end. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MUNCHABLE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

You acknowledge that you use the Service at your own risk. Any content downloaded, accessed, or otherwise obtained through the Service is done at your own discretion and risk. Munchable is not responsible for any food-related decisions you make based on content found on the platform.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MUNCHABLE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
IN NO EVENT SHALL MUNCHABLE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO MUNCHABLE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND EVEN IF MUNCHABLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to defend, indemnify, and hold harmless Munchable, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorney's fees) arising from or related to:

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
